Disputes frequently embroil parties in clearly inappropriate dispute resolution modalities because they are parties to agreements that contained standardized dispute resolution clauses that failed to take into account the kind of dispute likely to arise. We custom tailor our clauses with an eye to the future need of the client and the situation.
As an Advocate
We have extensive experience serving as an advocate during a mediation, arbitration, or collaborative law process, and in other settings where parties are represented by counsel. The skills required to effectively advocate in an ADR process are surprisingly different from those used in ordinary litigation, and our training and experience will be a tremendous asset in reaching resolution.
As a Neutral
We are trained third party neutrals, and are available to act as a mediator or arbitrator for your dispute. We can serve in this capacity for mediations and arbitrations which are conducted through service providers such as the AAA and JAMS, or in ad hoc proceedings which are handled privately.
As a Facilitator
ADR techniques can be effectively utilized to facilitate negotiation, group meetings, or in other situations where there is not necessarily a dispute in existence. Trained ADR professionals can help break an impasse in a deal negotiation, or help a large group assimilate disparate views in creating policy.
As a Consultant
We can work with other attorneys who are not ADR-trained to help them counsel their clients on available ADR alternatives. We can also come into corporate settings to help train human resources or legal staff on ADR methods and theories.
